Terms of Use
This translation is provided for convenience; the Japanese version prevails.
These Terms of Use (these "Terms") set out the conditions under which Takumi Nishimura (the "Operator") provides the iPhone app "poitto" (the "App"). By using the App, you are deemed to have agreed to these Terms.
Article 1 (What the App Does)
- The App lets AI create draft tasks, events, and notes from text and images you enter or share, and helps you organize and manage them.
- The App can be used free of charge. Subscribing to the paid plan "poitto Pro" unlocks additional features and a higher usage limit.
- AI sorting has a monthly usage limit (currently 20 times on the free plan and 300 times on poitto Pro). This limit may change.
Article 2 (Account)
- The App automatically creates an anonymous account the first time it launches, so you can use the App — including AI sorting — without registering via "Sign in with Apple."
- To use features you need to keep across a new device, such as purchasing poitto Pro or connecting a calendar, you must register an account from "Sign in with Apple / Create an Account" in Settings. Registering links your Apple sign-in to this anonymous account, so your prior AI usage count and data carry over as they are. If that Apple ID already has a registered account, you're switched to that account instead.
- You are responsible for managing your own account.
- You may delete your account or data at any time from "Settings → Account" within the App ("Delete Account" if registered, "Delete Data" if not).
- If you keep using the App anonymously without registering, a device change, device reset, or deletion of the App may make it impossible to carry over your prior AI usage count or data (see also Article 9 on data storage).
Article 3 (poitto Pro Subscription)
- poitto Pro is an auto-renewing subscription offered through the App Store's in-app purchases. The price is shown in the App and on the App Store's purchase screen at the time of purchase (regional pricing applies).
- Payment is charged to your Apple ID once you confirm the purchase. Purchases, billing, and payment are handled by Apple and are subject to Apple's Media Services Terms and Conditions.
- Unless canceled at least 24 hours before the end of the current period (monthly or yearly), poitto Pro renews automatically for the same period at the same price, and payment for the next period is charged within 24 hours before the current period ends.
- You can cancel from iPhone Settings → your name → "Subscriptions" → "poitto Pro." After canceling, you can keep using poitto Pro until the end of the period you already paid for.
- No prorated refund is given for canceling partway through a period. Refund requests are handled at Apple's discretion, through Apple's process (reportaproblem.apple.com).
- Deleting your account in the App does not cancel your poitto Pro subscription. Please cancel it separately using the steps above.
- The Operator may change the price or content of poitto Pro. If the price is changed, users will be notified in advance in accordance with Apple's rules.
- When your poitto Pro period ends, your plan reverts to Free. Data created while on poitto Pro (matrices, tags, recurrences, events written to your calendar, etc.) is not deleted, but you will no longer be able to add beyond the Free plan's limits or use some features.
Article 4 (About AI Results)
- Drafts created by AI (including titles, dates and times, locations, and priority) may be incorrect or incomplete.
- You must review a draft's content and correct it as needed before registering it. Registered content is your own decision.
- The Operator does not guarantee the accuracy, completeness, or usefulness of AI results.
Article 5 (Content You Toss In)
- You must only toss into the App content you have the right to use.
- If content includes another person's personal information, you must comply with applicable law and handle it appropriately.
- Content you toss in is handled in accordance with the Privacy Policy.
Article 6 (Prohibited Conduct)
You must not do any of the following:
- Act in violation of law or public order and morals.
- Infringe the copyright, privacy, or other rights of third parties.
- Place an excessive load on the App or its server, or use it in bulk via automated tools.
- Improperly circumvent usage limits, or impersonate another person.
- Reverse-engineer the App, or attempt unauthorized access.
- Use the App's AI feature for any purpose other than its intended purpose (organizing tasks, events, and notes).
- Any other conduct the Operator deems inappropriate.
Article 7 (Suspension of Use)
If you violate these Terms, the Operator may suspend or restrict your use of the App without prior notice.
Article 8 (Changes, Suspension, and Termination of the App)
- The Operator may change the content of the App, or suspend or terminate its provision.
- Features such as AI sorting may become temporarily unavailable due to maintenance, failures, or circumstances of external services (Apple, Google, Cloudflare, etc.).
Article 9 (Data Storage)
Tasks, events, and notes are stored mainly on your device. Data may be lost due to device failure, loss, or app deletion, and the Operator does not guarantee its recovery.
Article 10 (Disclaimer)
- The Operator does not warrant that the App is free of factual or legal defects (including with respect to safety, reliability, accuracy, fitness for a particular purpose, errors or bugs, or rights infringement).
- Except where caused by the Operator's willful misconduct or gross negligence, the Operator is not liable for damages you incur from using the App, including damages from missed tasks or events, or from notifications that did not arrive.
- Even where the preceding paragraph does not apply under Japan's Consumer Contract Act (Shōhisha Keiyaku Hō) or other applicable Japanese law, the Operator's liability is limited to ordinary, direct damages.
Article 11 (Changes to These Terms)
The Operator may change these Terms as needed. Changed Terms take effect once posted on this page. If you use the App after a change, you are deemed to have agreed to it.

Article 12 (Governing Law and Jurisdiction)
These Terms are governed by the laws of Japan. Any dispute relating to the App shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the Operator's location as the court of first instance.
